作者简介
黄宗智，普林斯顿大学学士，华盛顿大学博士，1966年始任教于UCLA历史系，1991年晋升“超级教授”，2004年荣休。主要著作有《华北的小农经济与社会变迁》（获美国历史学会费正清奖）、《长江三角洲的小农家庭与乡村发展》（获亚洲研究协会列文森奖）等。
Code, Customs and Judicial Practice
This book is the representative work of Professor Huang Zongzhi's legal and social history. Based on a large number of documents, the book makes a detailed review of the revision process of Chinese laws during the Qing Dynasty and the Republic of China. Starting from the litigation archives of Ba County, Baodi, Danshui-Hsinchu and other places, this paper compares and restores the differences between the civil law of Qing Dynasty and the civil law of the Republic of China in handling household, marriage, land and other civil disputes. The author observes the transformation of modern China from the legal changes of the Qing Dynasty and the Republic of China, and shows all kinds of similarities and differences between the civil laws of the Qing Dynasty and the Republic of China, as well as the complicated entanglement with the society. The book has a broad academic vision, uses interdisciplinary research methods, absorbs a large number of Chinese and foreign scholars such as Max Weber, Qu Tongzu, Shiga Shuzo and other authoritative achievements and tries to dialogue with them. From the perspective of "expression" and "practice", the author enters into the study of legal social history and deepens our understanding of Chinese history and reality.
About the author
Huang received a bachelor's degree from Princeton University and a doctorate from the University of Washington. He began teaching history at UCLA in 1966, was promoted to "Super Professor" in 1991, and retired in 2004. His major books include: Smallholder Economic and Social Change in North China (Fairbank Award, American Historical Association) and Smallholder Families and Rural Development in the Yangtze River Delta (Levinson Award, Asian Studies Association).
